Jonathan Cable - DA - Use of Deadly Force by L.C.P.O. (5.1.20) David A. Xanatos, 40 shot in testicles by rubber bullet/ killed by officer bobby bomar et al.

drunk guy with holstered knife drinking at parking lot, has a long interaction with lincoln city police on a quiet night during covid shutdown.

he doesnt give up his knife after a long talk with him about giving up his holstered knife.

no other options are presented.

a rubber bullet is fired, and then gunshots as he engages his knife after the shot into his testicles.

last words: "you shot me in the balls"

with the rubber bullet-----

he then moved to bobby bomar with the knife

shots fired.

i suggest that in a real city, the officers would be on to other more pressing cases than a longwinded hassling of a public intox at a rite aid during covid lockdown----perhaps called to a carjacking, a homicide, a chase. amirite?

lincoln city.

According to the DA’s statement, when Tolzman told the man he was being detained, the officer noticed the handle of a large knife sticking out of his waistband. The man provided an Idaho driver’s license number and was identified as David A. Xanatos, 40, of Payette, Idaho. Dispatchers informed officers that Xanatos had a prior felony conviction, as well as a pending weapons case out of Snohomish County, Wash. A total of five officers eventually arrived at the scene and flanked Xanatos outside of the Rite Aid store on the far southern end of the Safeway parking lot.

Accompanying his announcement finding the officers’ actions justified, Cable included body and dashboard camera footage showing a lengthy attempt to negotiate with Xanatos to surrender his knife, which officers believed might be illegal for him to possess due to his status as a felon. Xanatos refused, telling police he’d “grown attached to it.”

In the footage, officers warn Xanatos they will use a less-than-lethal weapon if he refuses to comply, and the video shows an officer firing a foam round at him, striking him in the groin. He initially recoils before continuing to approach police, drawing the knife from his waistband and lunging toward an officer. At that point, three officers on the scene — identified in Cable’s statement as Tolzman, Sgt. Robert Bomar and Officer Molly Wehrley — fire their weapons, shattering store windows and bringing Xanatos to the ground. He was transported to Samaritan North Lincoln Hospital, where he was pronounced deceased. Cable said in his statement that use of a Taser was not feasible because of Xanatos’ thick clothing.
